Alternative delivery projects

The Texas Legislature authorized the Texas Department of Transportation (TxDOT) to use alternative delivery contracting methods under Title 6, Subtitle B, Chapter 223, Subchapters E and F of the Texas Transportation Code. These contracts, primarily known as design-build (DB) and comprehensive development agreements (CDAs), are awarded using a best-value approach that evaluates price, proposer qualifications, and overall project approach.

Alternative delivery contracts allocate varying levels of risk and responsibility to the DB Contractor through the following procurement options:

• DB with a General Warranty
• DB with a Performance Warranty
• DB with a Capital Maintenance Contract (CMC)
• DB with a Comprehensive Maintenance Agreement (COMA)
• CDA

The Alternative Delivery Division (ALD) oversees and manages the Alternative Delivery Program (ADP).

DB contracts allow design, construction, utility relocation, and maintenance to occur simultaneously under a single contract. The contract does not include financial participation from the private sector, a long term-lease, or operation of the facility.

CDAs allow design, construction, utility relocation, and maintenance activities to occur simultaneously under a single contract. They may also include financial participation from the private sector and for long term lease or operation of the facility. CDAs can be a concession or a DB. TxDOT has five such projects in operation or under construction. It is important to note that broad authority to enter into new CDAs expired in 2017.

TxDOT continually analyzes potential projects to determine which would be most suitable as an alternative delivery contract. A quarterly report illustrates TxDOT’s planned procurements for the next five to ten years.

ALD provides support activities for the program and performs procurement of alternative delivery projects. Prior to beginning a procurement project, ALD collaborates with districts to advance project development activities and information to enhance the procurement process.

Procurement projects are approved by the Texas Transportation Commission to issue a request for qualifications (RFQ).
