Transit Federal and State Procurement Management
Material and supplies procurements are used to secure items necessary for daily operations. This list generally includes: Office or program supplies, transportation system equipment, low cost spare parts for fleet such as oil, filters, tires, and more. When procuring items in this category, an invitation for bid (IFB) or Request for proposal (RFP) may be used.
When a procurement is necessary for material and supplies, the following clauses should be included in the solicitation, as well as the standard clauses listed in procurement:
The contractor agrees to comply with the shipping requirements of 46 U.S.C. § 55305, and U.S. Maritime Administration regulations, “Cargo Preference – U.S.-Flag Vessels,” 46 C.F.R. part 381.
The selected contractor shall select products and services that conserve natural resources, protect the environment, and are energy efficient by complying with and facilitating compliance with all federal and state environmental laws.
Subrecipients are prohibited from doing business with certain companies, for a complete list, see 2 C.F.R. part 200.216.
Buy America requirements apply when material or supplies being procure cost more than $150,000. To be compliant with Buy America, the Recipient agrees to comply with FTA’s U.S. domestic preference requirements and follow federal guidance of 49 U.S.C. § 5323(j), and FTA regulations, “Buy America Requirements,” 49 C.F.R. part 661, to the extent consistent with 49 U.S.C. § 5323(j).
The Recipient agrees to the dispute resolution process provided for in Chapter 2260 of the Texas Government Code must be used to attempt to resolve any dispute under this Agreement.
