Federal Domestic Materials Program: Material Classification Sheet

The federal Buy America program is now known as the Federal Domestic Materials Program (FDMP).

The FDMP establishes domestic manufacturing and sourcing requirements for certain materials used in federally funded transportation projects. Beginning with Version 5 (Phase 2) implementation, TxDOT is applying what is referred to as the “duality of materials” approach to material classification. Under this approach, the classification of certain materials is not pre‑assigned by TxDOT, but instead may be determined by the manufacturer, supplier, or contractor, consistent with the definitions and limitations established in federal regulation. This approach recognizes that materials with similar functional use may be produced using different manufacturing processes or component compositions, resulting in different applicable classification outcomes.

When a material or product is not listed on the Material Producer List as Gold Star compliant, or is identified as “Project Level Certification Required,” Buy America documentation must be submitted and verified at the project level in accordance with contract requirements. Form 2806, "Construction Materials Buy America Certification," is used to document compliance for applicable construction materials and manufactured products based on the classification selected by the manufacturer, supplier, or contractor. The responsibility to determine the appropriate material classification and to certify compliance, including the provision of supporting documentation when requested, rests with the contractor, manufacturer, or supplier submitting the certification, not with TxDOT.

Material classification and documentation requirements vary based on the version of the FDMP in effect at the time of federal obligation, and users are responsible for applying the appropriate version‑specific guidance to their project.

Applicable to projects federally obligated on or after October 1,  2025 and before October 1, 2026 (December 2025 to December 2026 lettings with 2024 SP006-009)

  • Form 2806 - Version 2 is required for contracts on or after December 2023 with SP006-040. These contracts had a federal authorization date after 10/23/2023 (File requires download to view)
