Notice of Availability – FM 528 Finding of No Significant Impact

Purpose:

This notice is to advise the public that the Texas Department of Transportation (TxDOT) has issued a Finding of No Significant Impact (FONSI) for the proposed Farm-to-Market (FM) 528 project from State Highway (SH) 35B (Gordon Street) to SH 6 in Brazoria county, Texas.

Description:

The proposed FM 528 project would be constructed primarily on a new location, with a portion of the project following existing roadways. The proposed project includes:
  • An undivded two-lane roadway
  • Curbs and gutters
  • Bicycle accommodations
  • Sidewalk on the north side of FM 528
  • Grade separation at the Burlington Northern Santa Fe (BNSF) Railway
  • Signalized intersections at SH 35B (Gordon Street) and SH 6
  • Left turn lanes at SH 35B (Gordon Street)

In order to avoid noise impacts that may result from future development adjacent to a proposed highway project, a traffic noise analysis is included in the environmental document, which includes estimated noise impacts for currently undeveloped areas. This information is intended as a general guide to assist local planning officials and developers plan and construct new activities in locations that would not result in traffic noise impacts.

It is important to note that TxDOT is no longer responsible for providing noise reduction improvements, which can be referred to as noise abatement, for new development on the date of approval and/or clearance of an environmental document. TxDOT is also no longer responsible for the traffic noise analysis for a proposed highway project.

Copies of the FONSI, approved EA, and Opportunity for Public Hearing documentation for this project are available for public inspection and reproduction Monday through Friday between 8 a.m. and 5 p.m. at the following locations:

The environmental review, consultation, and other actions required by applicable federal environmental laws for this project are being, or have been, carried out by TxDOT pursuant to 23 U.S.C. 327 and a Memorandum of Understanding dated Dec. 16, 2014, and executed by FHWA and TxDOT.
