Purpose To receive public comment on proposed amendments to Chapter 21 rules concerning utility accommodation within TxDOT right of way.
Description TxDOT proposed amendments to 43 Tex. Admin. Code §§21.31, 21.37, 21.38, 21.40, and 21.41, concerning Utility Accommodation, and the proposed repeal of 43 Tex. Admin. Code §§21.921 - 21.930, concerning Utility Relocation Prepayment Funding Agreements. The text of the amendments and repeal were published in the April 15, 2022, issue of the Texas Register (47 TexReg 1976). Senate Bill 507, Acts of the 87th Legislature, Regular Session, 2021, requires that the Texas Transportation Commission (commission) adopt rules to create a right of way accommodation process for broadband-only providers. This bill triggered a comprehensive review of the department’s rules regarding utility accommodation within state right-of-way. The review resulted in this rulemaking revising Chapter 21, Subchapter C, Utility Accommodation, to provide for accommodation of broadband services and to address advances in technology and current construction practices and safety standards for all utility installations within state right-of-way. The review also revealed the need to repeal Chapter 21, Subchapter P, Utility Relocation Prepayment Funding Agreements, which addresses a utility relocation prepayment funding program under Transportation Code, §203.0922, which expired Sept. 1, 2013.
