4.4 Access Management
Access management assists in protecting the substantial public investment in transportation by preserving roadway efficiency and enhancing traffic safety. Access management can significantly reduce traffic accidents, personal injury, and property damage.
The State may regulate driveway location and design through its police powers.
Landlocking, however, through complete denial of access is beyond the State’s regulatory power. The State, however, may effectively regulate driveway location in accordance with statewide policy as long as the following two conditions are met:- Reasonable access is provided; and
- Land locking of an abutting property does not result.
