In some instances, TCEQ assumes the responsibility to investigate and remediate hazardous material on the rights of way. TxDOT has executed a "State Lead Master Agreement" with the Texas Commission on Environmental Quality (TCEQ) for temporary use of right of way during petroleum substance investigation and/or remediation which contains terms and conditions that must be followed. When TCEQ assumes the responsibility to investigate and/or remediate petroleum or hazardous substances, TCEQ issues a written project authorization.
