Enforcement
If the District determines the prime contractor
has failed to meet the established DBE goal, has not demonstrated
good faith efforts, or failed to correct DBE Program deficiencies,
TxDOT will initiate administrative action against the prime contractor
in accordance with applicable regulations. Administrative actions
may include the following:
- Withholding all or a percentage of monthly partial payments
- Liquidated damages
- Initiation of appropriate suspension or debarment or decertification proceedings
- Termination of the contract
- Referral of any unlawful actions to the appropriate enforcement agencies
- Other actions as appropriate
The District will notify the prime contractor in writing of
the determination. The notice will include the reasons for the determination
and specify the administrative action.
