TxDOT to the county tax assessor-collectors, statutory agents who provide
vehicle registration and titling services for citizens in Texas. This
information is provided to apprise the general public of issues affecting the
state’s vehicle titling and registration process.
PURPOSE
To inform you of the provisions of House Bill 2216 (copy
attached), enacted by the
80th Legislature, Regular Session, 2007.
DETAILS
House Bill 2216, effective June 15, 2007, amends Texas
Occupations Code,
Chapter 2301, Sale or Lease of Motor Vehicles, by creating a new
motor vehicle dealer classification, Independent Mobility Motor
Vehicle Dealer. Transportation Code, Chapter 503, Dealer’s and
Manufacturer’s Vehicle License Plates, is also amended to
include the new motor vehicle dealer classification.
This legislation requires independent mobility motor vehicle
dealers:
- to have a converter’s license and manufacturer’s certification (if
applicable) to install mobility devices on motor vehicles;
- to hold a General Distinguishing Number (GDN), maintain insurance
requirements, have a welder certification, and be registered with the National
Highway Traffic and Safety Administration; and
- to only sell, or arrange for sale and delivery, new mobility motor
vehicles that have been modified to include some type of handicapped
mobility device, provided the transaction occurs through or by a franchised
dealer of the motor vehicle’s chassis line-make.
COUNTY ACTION
As with all dealer transactions, verify the transferor has a
current general distinguishing number.
