Electronic Signatures on Surety Bond Power of Attorney (POA) |
These documents contain text of correspondence sent by
TxDOT to the county tax assessor-collectors, statutory agents who provide
vehicle registration and titling services for citizens in Texas. This
information is provided to apprise the general public of issues affecting the
state’s vehicle titling and registration process.
PURPOSE
To clarify policy regarding the acceptance of an electronic
signature on a Surety Bond POA accompanying a Certificate of
Title Surety Bond transaction. This Registration and Title
Bulletin (RTB) rescinds RTB 048-03.
DETAILS
We have been informed that some Certificate of Title Surety Bond
transactions are being rejected for bearing an electronic
signature on a Power of Attorney. It is the department’s policy
to accept electronic signatures on a Surety Bond POA if the POA
also includes an embossed or digital seal. All other POA’s must
have original signatures or be certified as a “true and correct
copy of the original.” The Certificate of Title Surety Bond must
include original signatures.
COUNTY ACTION
Effective immediately, please do not reject a bonded title
transaction if the Surety Bond POA has an electronic signature
and an embossed or digital seal.
