Positive and Negative Right of Way Improvement Sales Defined

Positive ROW Improvement Sale – An individual or a company pays the department for the improvement and removes all improvements from the parcel. Generally, mobile homes and residential houses on pier and beam are good candidates for this type of sale.

Negative ROW Improvement Sale – The department pays an individual or a company to remove all improvements from the parcel. Commercial buildings and residential houses having a slab foundation are the most predominant structures disposed of in this manner. It is not uncommon for these types of structures to have varying degrees of asbestos-containing materials. The cost to the contractor for abating the asbestos often overrides the benefits of the value of removed building materials, thereby, causing a negative bid.
