Administrative rules for TxDOT are developed to comply with the
Administrative Procedure Act and enforce department policy and procedure outside
the department. The Act directs TxDOT to seek ideas and information from the
public and open the policy-making process to the public. Publication of proposed
actions and a comment period are the major components of the rulemaking process.
The Texas Transportation Commission approves rules for
proposed adoption. The
rules are then published in the
Texas Register.
Following the comment period, the commission members consider public input before approving final rules. All of the department's
administrative rules are part of the
Texas Administrative Code.
Proposed Rules
The Texas Transportation Commission has approved the following rules for
proposal and publication in the proposed rule section of the Texas Register.
They are open for comments for a minimum of 30 days or until the comment
deadline listed. Please address your comments to the person at the address
listed in the Submittal of Comments section of the Preamble. After the comment
period has closed, TxDOT evaluates all comments and responds to them in the
final adoption preamble. The rule is then presented at the
commission meeting.
Once the final rule is approved by the commission, the rule is submitted to the
Texas Register for final adoption. See Adopted Rules below.
