The following information details TxDOT guidelines for using TxDOT free software, including this software product. By installing or using this software, you are deemed to have read, understood and accepted the following terms and conditions. If you do not agree with these terms and conditions, do not install or use this software product.

CHANGES TO THE GUIDELINES

TxDOT reserves the right to change these guidelines solely at its discretion.

PROPRIETARY RIGHTS

This is proprietary software of TxDOT and may contain TxDOT trademarks. By using this software, you acknowledge TxDOT's ownership of the copyright and trademarks. All use of or goodwill associated with the TxDOT software shall inure to TxDOT's benefit. Any license issued to you is nonexclusive and non-transferable.

LICENSE FEE

TxDOT agrees to waive the license fee but reserves the right to charge a fee by giving electronic notice on TxDOT's Web site.

USE OF SOFTWARE

TxDOT is not responsible for providing upgrades, notification of upgrades, modifications, or corrections to the software. TxDOT will not provide you with technical support for using the software. TxDOT does not make any warranties or representations regarding the software, including but not limited to the content of the software, the suitability of the software for your use, the information obtained by you from using the software, or the compatibility of the software with your computer. You accept the software "as-is" with all possible faults, and TxDOT is not liable for any incidental, consequential, or special damages of any kind.

You agree to comply with all federal, state and local laws, statues, ordinances, rules and regulations, and the orders and decrees of any court or administrative body that affect the performance of this agreement.

This software product requires the purchase of additional commercial software from Adobe to function. TxDOT will not provide any software other than this installation package and does not make any warranties or representations regarding Adobe products. Usage of this software product is restricted to TxDOT projects.

TERMINATION

TxDOT reserves the right to immediately terminate permission to use the software to anyone not following these guidelines as determined solely by TxDOT's judgment. In addition, TxDOT may terminate use of this entire program by giving 30 days electronic notice on TxDOT's Web site.

LEGAL CONSTRUCTION

If any of the provisions of this agreement are held unenforceable, the remaining provisions with be construed as if the unenforceable provision had never been included.

By installing or using this software, you warrant that you or your firm have the authority to enter into this agreement, and you or your firm are deemed to have signed the license agreement to the extent as if your written signature were contained on this agreement.
